Summary: In 1857, Mershon sold eighty acres of land to Oliver and Milner for $1,000. Oliver and Milner gave five promissory notes as payment, and Mershon sued after they failed to meet the first payment of $270.40. Oliver and Mershon, represented by Lincoln, pleaded that Mershon did not have title to the land and that he had tried to sell the land to others since he considered the contract void after the default. The jury found for Oliver and Milner and awarded them $100.
