Summary: Alsop gave Stuart two promissory notes totaling $360.38 and secured the notes with a mortgage on two lots in Springfield, Illinois. Stuart and Edwards won a judgment for the St. Louis firm of Henry and Valle against Alsop and Horace Hickox. During the settlement of that judgment, Stuart mistakenly entered in the Recorder's Office record that the deed of trust held as security on the Alsop notes had been satisfied. The correct deed did not involve the Alsop transaction. In the meantime, Stuart sold the Alsop notes and mortgage to Chatterton. Also, Virgil Hickox purchased the judgment against Alsop and Horace Hickox and had the court sell the mortgaged lots to satisfy that judgment. Chatterton retained Lincoln and Herndon and sued Virgil Hickox, Horace Hickox, and Alsop to have the court correct the Stuart error in the Recorder's Office, void the Hickox sale of the mortgaged lots, and clear the title on the lots so that Chatterton might sell them if Alsop failed to pay the notes. The defendants defaulted, and the court ordered the master in chancery to execute the decree. The master in chancery corrected the recording error, voided the Hickox sale, and sold the two lots at public auction to Chatterton for $429.41 after Alsop failed to pay the balance of $342.14 on the notes.
