Summary: Thomas Jones gave O'Brian two promissory notes of $386 each and a deed for twenty-nine acres as security. O'Brian assigned one of the notes to Gleeson, but Jones died before paying the note. Gleeson sued Jones's widow, Catherine Jones, and three minor children to foreclose the mortgage. Catherine Jones defaulted, and the court ruled, with Lincoln writing the decree, that the defendants owed Gleeson $295.57. They could not pay the decree, and the court sold the land to Gleeson for $328.23. Lincoln's role is not clear; he wrote the decree and the plaintiff's replication for McClernand, and also sat as judge during part of the March 1859 term of the Logan County Circuit Court.
