Averill Harriman, Wall Street Financier, asserted and was corroborated by his partner, J.P. Ripley, that the firm of Harriman, Ripley, & Co. set up in 1934, was not established to side-step the Banking Act of 1933. The act divorced securities business from commerical banking in banking houses. He asserts that the firm was set up to provide for the future of those employees of the National City Co. whose investment and underwriting activities were ended by the Act of 1933. John Rougge, Securities and Exchange Commission lawyer, was yesterday nominated by President Roosevelt to be an assistant attorney general in charge of the Criminal Division of the Department of Justice. Appearing before the Senate Finance Committee today, Undersecretary of the Treasury Roswell Magill suggested retention of the undistributed profits tax in the new revenue bill and strongly recommend elimination of tax exemption for government securities. At the same time he informed the committee of the treasury's views on the tax revision bill, designed to provide $5,330,000,000 in federal revenue. Mystery' employee appears before S.E.C. Washington, D.C., May 24. Ben Greay, so-called 'mystery' employee of the Associated Gas and Electric Co., pictured as he arrived at the Securities and Exchange Commission today for questioning. Grey, who was on the utility's payroll at $5,000 a month for 11 months, told the S.E.C. that the White House made an appointment for him to see Frank R. McNinch, then head of the Federal Power Commission. He would not say who at the White House arranged the appointment but did not admit that he spent an hour with McNinch and told him that Associated Gas and Electric Co. would be willing to spend as much as $150,000,000 for new construction if tax liens would be lifted temporarily so the company could refund certain securities. He testified he also met with Ben Cohen and with late Herman Oliphant, Treasury Counsel. He said Secretary of Treasury Morgenthau refused him an interview

S.E.C. reports to White House. Washington, D.C., April 13. The Securities and Exchange Commission held an informal conference this morning before leaving for the White House where Chairman James M. Landis told President Roosevelt that the Commission hopes to complete its corporate reorganization study soon and transmit a report to Congress. the study, Landis said, will deal with foreign bond defaults, Judicial reorganization procedure and other reorganization plans. he indicated the report may result in regulatory legislation "to protect investors" in the photograph, left to right: Commissioners George C. Complete preliminary investigation of Life Insurance Companies for S.E.C. Washington, D.C., Nov. 4. Completing a preliminary investigation of Life Insurance Companies for the Securities and Exchange Commission, Gerhard Gesell, who served as the SEC's Chief Counsel in the investigation of the Richard Whitney case, and Ernest J. Howe, SEC Chief Financial Advisor, have begun to prepare the material which they will present at public hearings of the Monopoly Study Committee in January. Questionnaires, designed to disclose the corporate set-up of the companies, were sent to 406 life insurance firms. All but about 35, who were given extensions of time, answered and returned them to the SEC by Oct. 1, 11/4/38

Ruth, President of the Liberty Bond and Share Corporation of Buffalo, told his Corporation granted loans to their officers, employees, and former employees on collateral that decreased in value until it was worth only 15 cents on the dollar. He also related how the Liberty Bond and shares assets shrunk from $10,004,00 on April 2, 1929 to $716,00 on Sept. 30, 1936
