Summary: Dade gave Archer Herndon, William Herndon's father, a promissory note for $400, and secured the note with a mortgage on more than eighty acres of land in Sangamon County, Illinois, and a partial lot in Benton, Illinois. Dade sold the lands to Jones but failed to pay Archer Herndon. Archer Herndon retained Lincoln and William Herndon and sued Dade and Jones to foreclose the mortgage. Dade and Jones failed to appear, and the court ruled for Herndon and awarded $473.89 in damages. Dade and Jones failed to pay the judgment, and the court sold the land to Jones for $530.47.
